Terms of Service

The rules that govern using My Easy Party — what we offer, what we ask of customers and vendors, and how disputes are handled.

Acceptance

By creating an account, listing a service, or booking through My Easy Party, you agree to these Terms of Service. If you don't agree, please don't use the platform.

Service Description

My Easy Party is an online marketplace connecting customers planning events with local vendors that supply party services. We provide the platform, search, messaging, booking, payments, and dispute handling. We are not the vendor — vendors are independent businesses responsible for the services they list.

TODO (Itta + counsel):Counsel: clarify marketplace-intermediary positioning to limit platform liability for vendor performance. Mirror language used by comparable Canadian marketplace operators.

User Accounts

To book or list, you must register an account with accurate information, keep your credentials secure, and accept responsibility for activity under your account. You must be old enough to enter into a binding contract in your jurisdiction.

TODO (Itta + counsel):Set minimum age (18 or province-dependent), define account-sharing rules, and describe the suspension / reinstatement process.

Vendor Obligations

Vendors must hold the licences, permits, and insurance required for the services they list. Vendors are responsible for accurate listings, honouring accepted bookings, delivering the agreed service, and complying with consumer-protection law in the jurisdictions they serve.

TODO (Itta + counsel):Counsel: enumerate sector-specific licensing (food handling, alcohol, fireworks, etc.) and the insurance minimums platform requires.

Customer Obligations

Customers must provide accurate booking details, be present (or designate a person) to receive the service, communicate respectfully with vendors, and pay agreed amounts in full and on time.

TODO (Itta + counsel):Confirm no-show / venue-access expectations and how customer-caused non-delivery affects refund eligibility.

Payments

Payments are processed by Stripe. My Easy Party holds funds in escrow from booking until delivery, releasing them to the vendor on completion. Service fees and taxes are itemized at checkout.

TODO (Itta + counsel):Counsel: confirm escrow language is consistent with Stripe Connect terms. Disclose platform-fee percentage and currency-conversion treatment.

Cancellation & Refunds

Cancellation windows and refund eligibility depend on vendor policy and how close to the event you cancel. See our FAQ for the current cancellation matrix.

TODO (Itta + counsel):Counsel: finalize cancellation windows (e.g. 100% refund >14 days, 50% 7–14 days, 0% <7 days) and any vendor-overridable defaults.

Disputes

If a booking goes wrong, customers can open a dispute from the order detail page. Our admin team reviews evidence from both sides and adjudicates to one of three outcomes: customer-favour refund, vendor-favour release, or partial split. See our FAQ for the dispute timeline.

TODO (Itta + counsel):Counsel: define escalation to small-claims / arbitration if either side rejects the platform decision. Confirm dispute window (currently 14 days post-event in the build).

Intellectual Property

The My Easy Party name, logo, software, and design are owned by us. Content you upload (listing photos, reviews, messages) remains yours, but you grant us a licence to display and distribute it on the platform for the purpose of operating the service.

TODO (Itta + counsel):Counsel: precise licence scope (sublicensable, royalty-free, irrevocable for cached copies?). DMCA-equivalent takedown process under Canadian copyright law.

Liability

The platform is provided as-is. To the maximum extent permitted by law, My Easy Party is not liable for vendor performance, indirect damages, or losses outside our reasonable control. Our aggregate liability is capped at the fees you paid us in the twelve months before the claim.

TODO (Itta + counsel):Counsel: confirm enforceability of liability cap in the user's province of residence. Carve-outs for negligence and statutory consumer rights.

Indemnification

You agree to indemnify and hold harmless My Easy Party from claims arising out of your use of the platform — including any breach of these terms, violation of law, or infringement of third-party rights.

TODO (Itta + counsel):Counsel: typical mutual-indemnity language for marketplaces; clarify how legal-defence costs are allocated.

Termination

You can close your account from your profile at any time. We can suspend or close accounts that violate these terms, harm other users, or create legal risk. We will give reasonable notice except where immediate action is required (fraud, safety, court order).

TODO (Itta + counsel):Define what happens to open bookings, escrowed funds, and uploaded content on termination. Retention obligations under privacy law.

Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes are subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.

TODO (Itta + counsel):Counsel: confirm choice-of-forum versus mandatory arbitration. Consumer- protection law in other provinces may override choice-of-law for residents there.

Modifications

We may update these terms from time to time. Material changes are announced on this page with a new “Last updated” date and, where required, by email or in-app notice before they take effect.

TODO (Itta + counsel):Define “material change” and the minimum notice period (e.g. 30 days). Set a versioning model so old terms remain available for past bookings.
